Selection of the Contractor recruiting candidates for studies conducted at the Medical University of Silesia in Katowice in English language in the fields of medicine, medicine and dentistry and nursing for the academic years 2024/2025 and 2025/2026

1. The Contractor is obliged to submit, along with the offer, two separate statements regarding the absence of grounds for exclusion and the fulfillment of participation conditions in the proceedings, as indicated by the Ordering Party, as referred to in Article 125 item 1 of the Pzp (Public Procurement Law). The statements serve as evidence confirming the lack of grounds for exclusion of the Contractor and the fulfillment of participation conditions in the proceedings on the day of submitting the offers, temporarily replacing the individual means of proof required by the Ordering Party, as indicated in the SWZ.
1) The first declaration regarding non-exclusion is based on Article 5k of Regulation 833/2014 as amended by Regulation 2022/576, and regarding non-exclusion under Article 7 item 1 of the Act of April 13, 2022, on special measures to counter support for aggression against Ukraine and to protect national security - a template of such a declaration is provided in Attachment No. 8 to the SWZ.
2) The second declaration regarding non-exclusion, meeting the participation conditions, is submitted on the standard European Single Procurement Document (ESPD), form, drawn up in accordance with the standard form specified in Commission Implementing Regulation (EU) 2016/7 of January 5, 2016, establishing the standard form for the European Single Procurement Document, hereinafter referred to as "ESPD".

2. The Ordering Party shall, prior to selecting the most advantageous tender, invite the Contractor whose tender has been rated the highest to submit, within a specified period not less than 10 days, updated, as of the date of submission, the following documentary evidence:

2.1. Information from the National Criminal Register issued not earlier than 6 months before its submission, concerning:
1) specified in section 1 points 1.1 and 1.2 of CHAPTER VII of the SWZ (Article 108 item 1 points 1 and 2 of the Pzp), concerning final convictions for specified crimes, and
2) specified in section 1 point 1.4 of CHAPTER VII of the SWZ (Article 108 item 1 point 4 of the PZP).

2.2. The Contractor's statements concerning the scope indicated in section 1 point 1.5 of CHAPTER VII of the SWZ (Article 108 item 1 point 5 of the PZP), regarding the lack of affiliation with the same capital group within the meaning of the Act of February 16, 2007, on Competition and Consumer Protection with another Contractor who submitted a separate offer in the proceedings, or a statement of affiliation with the same capital group along with documents or information confirming the independent preparation of the offer from another Contractor belonging to the same capital group. The Contractor may prepare the statement according to the template provided in Attachment No. 7 to the SWZ.

2.3. The Contractor's declarations regarding the currency of the information contained in the statement:
1) Single European Procurement Document (ESPD) in terms of the grounds for exclusion from the proceedings referred to in Chapter VII, paragraph 1, points 1.3 - 1.6 (Article 108, paragraph 1, points 3-6 of PPL),
2) Declaration referred to in paragraph 1.1, with respect to the grounds for exclusion from the proceedings referred to in Chapter VII, paragraph 1.7 - 1.8.
A template of such a statement is attached as Attachment 9 to the SWZ.

3. The Contractor whose tender will be awarded the highest mark, in order to prove that he meets the conditions for participation in the procedure (specified by the Ordering Party in Chapter VIII of the SWZ), pursuant to Article 126 item 1 of the act, will be requested to submit the following subjective evidence (valid as at the date of submission):

3.1 a list of services conducted and, in the case of periodic or continuous services, also performed in the last 3 years, and if the period of contractor’s’ activity is shorter - in this period, together with their value, subject, dates of performance and entities for which the services were performed or are performed, and the attachment of evidence indicating whether these services were performed or are performed duly.

4. Contractor whose registered office or place of residence is outside the borders of the Republic of Poland:

4.1. instead of the information from the National Criminal Register referred to above – they should submit information from a relevant register such as the court register or, if there is no such register, another equivalent document issued by a competent judicial or administrative authority of the country in which the Contractor has registered office or place of residence, within the scope referred to in item 1 points 1.1, 1.2 and 1.4 of Chapter VII of the SWZ (art. 108 item 1 points 1, 2 and 4 of the PPL). This document should be issued no earlier than 6 months prior to its submission.

4.2. If, in the country in which the Contractor has registered office or place of residence the documents referred to above are not issued, or if such documents do not relate to all cases referred to in items 1.1, 1.2 and 1. 4, they shall be replaced in whole or in part, respectively, by a document containing a declaration of the Contractor, indicating the person or persons authorized to represent them, or a sworn statement of the person to whom the document refers, or, if in the country where the Contractor has its registered office or place of residence there are no provisions on sworn declaration, a statement made before a judicial or administrative authority, notary, professional or economic self-government body competent with regard to the Contractor’s registered office or place of residence.

1. Wykonawca zobowiązany jest złożyć wraz z ofertą oświadczenie (dwa odrębne) o niepodleganiu wykluczeniu, spełnianiu warunków udziału w postępowaniu, w zakresie wskazanym przez Zamawiającego, o których mowa w art. 125 ust. 1 Pzp. Oświadczenia stanowią dowód potwierdzający brak podstaw wykluczenia Wykonawcy oraz spełniania przez niego warunków udziału w postępowaniu na dzień składania ofert, tymczasowo zastępujący wymagane przez Zamawiającego podmiotowe środki dowodowe, wskazane w SWZ.
1) Pierwsze oświadczenie o niepodleganiu wykluczeniu na podstawie art. 5k rozporządzenia 833/2014 w brzmieniu nadanym rozporządzeniem 2022/576 oraz o niepodleganiu wykluczeniu na podstawie art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego – wzór takiego oświadczenia stanowi załącznik nr 8 do SWZ.
2) Drugie oświadczenie o niepodleganiu wykluczeniu, spełnianiu warunków udziału w postępowaniu składa się na formularzu jednolitego europejskiego dokumentu zamówienia, sporządzonym zgodnie ze wzorem standardowego formularza określonego w rozporządzeniu wykonawczym Komisji (UE) 2016/7 z dnia 5 stycznia 2016 r. ustanawiającym standardowy formularz jednolitego europejskiego dokumentu zamówienia, zwanego dalej „JEDZ”.

2. Zamawiający przed wyborem najkorzystniejszej oferty wezwie Wykonawcę, którego oferta została najwyżej oceniona, do złożenia w wyznaczonym terminie, nie krótszym niż 10 dni, aktualnych na dzień złożenia następujących podmiotowych środków dowodowych:

2.1. Informacji z Krajowego Rejestru Karnego sporządzonej nie wcześniej niż 6 miesięcy przed jej złożeniem, w zakresie:
1) wskazanym w ust. 1 pkt 1.1 i 1.2 Rozdziału VII SWZ (art. 108 ust. 1 pkt 1 i 2 Pzp), dotyczącej prawomocnego skazania za określone przestępstwa oraz
2) wskazanym w ust. 1 pkt 1.4 Rozdziału VII SWZ (art. 108 ust. 1 pkt 4 Pzp).

2.2. Oświadczenia Wykonawcy w zakresie wskazanym w ust. 1 pkt 1.5 Rozdziału VII SWZ (art. 108 ust. 1 pkt 5 Pzp), o braku przynależności do tej samej grupy kapitałowej w rozumieniu ustawy z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów z innym Wykonawcą, który złożył odrębną ofertę w postępowaniu, albo oświadczenie o przynależności do tej samej grupy kapitałowej wraz z dokumentami lub informacjami potwierdzającymi przygotowanie oferty niezależnie od innego Wykonawcy należącego do tej samej grupy kapitałowej. Oświadczenie Wykonawca może sporządzić zgodnie ze wzorem stanowiącym załącznik nr 7 do SWZ.

2.3. Oświadczenia Wykonawcy o aktualności informacji zawartych w oświadczeniu:
1) JEDZ, w zakresie podstaw wykluczenia z postępowania, o których mowa w Rozdziale VII ust. 1 pkt 1.3 - 1.6 (art. 108 ust. 1 pkt 3-6 Pzp),
2) o którym mowa w ust. 1 pkt 1, w zakresie podstaw wykluczenia z postępowania, o których mowa w Rozdziale VII ust. 1 pkt 1.7 - 1.8.
wzór takiego oświadczenia stanowi załącznik 9 do SWZ.

3. Wykonawca, którego oferta zostanie najwyżej oceniona, w celu wykazania spełniania warunków udziału w postępowaniu (określonych przez Zamawiającego w rozdziale VIII SWZ), na podstawie art. 126 ust. 1 ustawy zostanie wezwany do złożenia następujących podmiotowych środków dowodowych (aktualnych na dzień ich złożenia):

3.1 wykazu usług wykonanych, a w przypadku świadczeń okresowych lub ciągłych również wykonywanych, w okresie ostatnich 3 lat, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wraz z podaniem ich wartości, przedmiotu, dat wykonania i podmiotów, na rzecz których usługi zostały wykonane lub są wykonywane oraz załączenia dowodów określających, czy te usługi zostały wykonane lub są wykonywane należycie.

4. Wykonawca, który ma siedzibę lub miejsce zamieszkania poza granicami Rzeczypospolitej Polskiej:

4.1. zamiast informacji z Krajowego Rejestru Karnego, o której mowa powyżej – składa informację z odpowiedniego rejestru, takiego jak rejestr sądowy, albo, w przypadku braku takiego rejestru, inny równoważny dokument wydany przez właściwy organ sądowy lub administracyjny kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania, w zakresie, o którym mowa w ust. 1 pkt 1.1, 1.2 i 1.4 Rozdziału VII SWZ (art. 108 ust. 1 pkt 1, 2 i 4 Pzp). Dokument ten powinien być wystawiony nie wcześniej niż 6 miesięcy przed jej złożeniem.

4.2. Jeżeli w kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania, nie wydaje się dokumentów, o których mowa powyżej, lub gdy dokumenty te nie odnoszą się do wszystkich przypadków, o którym mowa w ust. 1 pkt 1.1, 1.2 i 1.4, zastępuje się je odpowiednio w całości lub w części dokumentem zawierającym odpowiednio oświadczenie Wykonawcy, ze wskazaniem osoby albo osób uprawnionych do jego reprezentacji, lub oświadczenie osoby, której dokument miał dotyczyć, złożone pod przysięgą, lub, jeżeli w kraju, w którym wykonawca ma siedzibę lub miejsce zamieszkania nie ma przepisów o oświadczeniu pod przysięgą, złożone przed organem sądowym lub administracyjnym, notariuszem, organem samorządu zawodowego lub gospodarczego, właściwym ze względu na siedzibę lub miejsce zamieszkania wykonawcy.
