Na potwierdzenie spełniania warunków udziału w postępowaniu należy przedłożyć:

1. The condition will be met if the Contractor demonstrates that it has obtained Good Laboratory Practise (GLP) certification, ISO 17025:2017 certified with appropriate certificates and has approval from the Local Bioethics Committee to conduct animal testing (if applicable).
To confirmation of meeting the conditions for participation in the procedure, must be submitted:
1. Certificates (copies certified to be true copies of the original) confirming that Good Laboratory Practice certification, ISO 17025:2017, and Local Bioethics Committee approval for animal testing have been obtained (if applicable).
Uprawnienia do wykonywania określonej działalności lub czynności

Wykonawca powinien posiadać uprawnienia do prawidłowego wykonywania określonej działalności lub czynności, jeżeli przepisy prawa nakładają obowiązek ich posiadania. Warunek ten uważa się za spełniony, jeśli Wykonawca złoży stosowne oświadczenie
w przedmiotowym zakresie w treści formularza oferty, stanowiącego załącznik do niniejszego Ogłoszenia.

The Contractor should have the authorizations to properly perform specific activities if the legal regulations require such authorizations. This condition is considered fulfilled if the Contractor submits an appropriate statement in this regard in the proposal form attached to this Notice.
Dodatkowe warunki udziału

W celu uniknięcia konfliktu interesów zamówienie, którego dotyczy niniejsze zapytanie ofertowe, nie będzie udzielane podmiotom powiązanym z Zamawiającym osobowo lub kapitałowo. Przez powiązania kapitałowe lub osobowe rozumie się wzajemne powiązania między Zamawiającym lub osobami upoważnionymi do zaciągania zobowiązań w imieniu Zamawiającego lub osobami wykonującymi w imieniu Zamawiającego czynności związane z przygotowaniem i przeprowadzeniem procedury wyboru wykonawcy a wykonawcą, polegające w szczególności na:
a) uczestniczeniu w spółce jako wspólnik spółki cywilnej lub spółki osobowej,
b) posiadanie co najmniej 10 % udziałów lub akcji,
c) pełnieniu funkcji członka organu nadzorczego lub zarządzającego, prokurenta, pełnomocnika,
d) pozostawaniu w związku małżeńskim, w stosunku pokrewieństwa lub powinowactwa w linii prostej, pokrewieństwa drugiego stopnia lub powinowactwa drugiego stopnia w linii bocznej lub w stosunku przysposobienia, opieki lub kurateli.
Do przedkładanej oferty należy wobec powyższego załączyć podpisane oświadczenie, stanowiące załącznik nr 3 do niniejszego zapytania.

In order to avoid conflicts of interest, a contract to which this tender inquiry relates will not be awarded to any entity with a personal or capital relationship with the Contracting Authority. A capital or personal relationship is understood as a mutual relationship between the Contracting Authority or persons authorized to incur obligations on behalf of the Contracting Authority, or persons performing activities on behalf of the Contracting Authority related to the preparation and conducting the contractor selection procedure and the contractor, consisting in particular of:
a) participation in the company as a partner in a civil partnership or partnership,
b) holding at least 10% of shares or stocks,
c) being a member of a supervisory or managing body, proxy or attorney,
d) being married, in a relationship of kinship or affinity in a straight line, kinship of the second degree or affinity of the second degree in a collateral line, or in a relationship of adoption, custody or guardianship.
In view of the above, the bid submitted should be accompanied by a signed statement constituting Attachment No. 3 to this inquiry.
Lista wymaganych dokumentów/oświadczeń

Poprawnie sporządzona i kompletna oferta winna składać się z następujących dokumentów:
a) Formularz oferty - wedle wzoru Załącznika nr 2,
b) Oświadczenie Wykonawcy o braku powiązań kapitałowych lub osobowych - wedle wzoru Załącznika nr 3,
c) Wykaz usług wykonanych lub wykonywanych w okresie ostatnich 3 lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wraz z podaniem ich przedmiotu, dat wykonania
i podmiotów, na rzecz których usługi zostały wykonane - wedle wzoru załącznika nr 4.
d) Certyfikaty (kopie potwierdzone za zgodność z oryginałem) potwierdzające uzyskanie certyfikacji Dobrej Praktyki Laboratoryjnej, ISO 17025:2017 oraz zgodę Lokalnej Komisji Bioetycznej na prowadzenie badań na zwierzętach (jeśli dotyczy).
e) Dokument zawierający szczegółową specyfikację oferowanej usługi, spełniającą wymagania co do parametrów ujętych w Załączniku nr 1. Dokument musi zawierać opis oferowanej usługi, sporządzony w sposób, który umożliwia Zamawiającemu identyfikację wszystkich wymaganych parametrów,
f) Aktualny odpis z właściwego rejestru lub z centralnej ewidencji informacji
o działalności gospodarczej, wystawiony nie wcześniej niż 6 miesięcy przed upływem terminu składania ofert (oryginał lub kopia poświadczona za zgodność
z oryginałem przez osobę upoważnioną do reprezentowania Wykonawcy, dopuszcza się złożenie dokumentu w formie wydruku ze strony internetowej),
g) Oferta musi być podpisana, w miejscach przeznaczonych na podpis, przez osobę lub osoby uprawnione do reprezentowania Wykonawcy. W przypadku, gdy uprawnienie do reprezentacji nie wynika z przedłożonych wraz z ofertą dokumentów, do oferty należy dołączyć stosowne pełnomocnictwo lub inny dokument potwierdzający uprawnienie do reprezentacji Wykonawcy.
h) Oferta powinna zawierać cenę podaną w PLN w kwotach brutto i netto.
W przypadku podania przez Wykonawcę wartości zamówienia w walucie innej niż PLN, jej wartość zostanie przeliczona w PLN z zastosowaniem kursu wymiany opublikowanym przez Narodowy Bank Polski w Tabeli A, z dnia upływu terminu składania ofert.

A properly prepared and complete offer should consist of the following documents:
a) Tender form, according to the template in Appendix no. 2,
b) Declaration of the Contractor on absence of capital or personal relations, according to the template as Attachment no. 3,
c) List of services performed or being performed during the last 3 years before the deadline for submission of tenders, and if the period of business activity is shorter - in this period, along with their subject matter, date of performance and entities for which they were performed - according to the template of attachment no. 4.
d) Certificates (copies certified to be true copies of the original) attesting to Good Laboratory Practice certification, ISO 17025:2017, and Local Bioethics Committee approval to conduct animal research (if applicable).
e) A document containing a detailed specification of the offered service, meeting the requirements of the parameters included in Attachment 1. The document must include a description of the service offered, written in a manner that allows the Contracting Officer to identify all required parameters,
f) A current excerpt from the appropriate register or from the central register of information on business activity, issued max. 6 months before the deadline for submitting tenders (original document or a copy certified to be true by a person authorized to represent the Contractor, it is acceptable to submit the document as a printout from the website),
g) The offer has to be signed, in places designated for signature, by a person or persons authorized to represent the Contractor. If the right to representation does not result from the documents submitted with the offer, a power of attorney or another document confirming the right to represent the Contractor shall be attached to the offer.
h) A tender should contain a price expressed in PLN, both in gross and net amounts. If the value of the contract is given by the Contractor in a currency other than PLN, its value will be converted into PLN using the exchange rate published by the National Bank of Poland in Table A on the closing date for submitting offers.

Warunek zostanie spełniony, jeżeli Wykonawca wykaże, że w okresie ostatnich trzech lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wykonał należycie co najmniej jedną ocenę biologiczną wyrobu medycznego dla wyrobu medycznego(in vitro i in vivo), którego surowcem lub komponentem jest nanomateriał.
2. Warunek zostanie spełniony, jeżeli Wykonawca wykaże, że w okresie ostatnich trzech lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wykonał należycie co najmniej usługę lub/i usługi prowadzenia badań biokompatybilności dla co najmniej dwóch wyrobów medycznych stosowanych w uzupełnianiu ubytków kostnych.
Na potwierdzenie spełniania warunków udziału w postępowaniu należy przedłożyć:
Wykaz usług wykonanych lub wykonywanych w okresie ostatnich 3 lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wraz z podaniem ich przedmiotu, dat wykonania i podmiotów, na rzecz których usługi zostały wykonane.

The condition will be fulfilled if the Economic Operator demonstrates that in the last three years before the deadline for submission of tenders, and if the period of activity is shorter - during this period, he has duly performed at least one biological evaluation of a medical device for a medical device (in vitro and in vivo), the raw material or component of which is a nanomaterial..
2. The condition will be fulfilled if the Contractor demonstrates that in the last three years before the deadline for submission of tenders, and if the period of operation is shorter - during this period, it has duly performed at least a service and/or services of conducting biocompatibility tests for at least two medical devices used in bone replacement.
To confirmation of meeting the conditions for participation in the procedure, must be submitted:
